Fargo Man Ordered to Take Down US Flag Because it’s Too Noisy

Andrew Almer’s con­do asso­ci­a­tion ordered him to take the Unit­ed States flag down from his bal­cony, claim­ing it’s too loud.

For­tu­nate­ly, the Fed­er­al Free­dom to Dis­play the Amer­i­can Flag Act of 2005 for­bids HOAs or oth­er res­i­den­tial asso­ci­a­tions to make res­i­dents remove a US flag.

Unfor­tu­nate­ly, the act also allows “rea­son­able restric­tions” if they’re “nec­es­sary to pro­tect a sub­stan­tial inter­est” of the asso­ci­a­tion.

The con­do asso­ci­a­tion is threat­en­ing Almer with huge fines, but he refus­es to take the flag down.
